Abstract

This paper analyzes the legal conflict generated between the owners of trademark rights and the prohibition of the use of distinctive signs consisting of characters, caricatures or celebrities in products that include one or more elements of the front-of-package labeling system in accordance with the Regulations of the General Health Law on Advertising. The positions of those affected by the aforementioned regulation will be analysed, as well as the legislator’s reasons for prohibiting the use of the aforementioned distinctive signs for the sake of public order and social interest.
